Please read these Terms of Service carefully before using Consistly. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account or using Consistly, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service.
2. Description of Service
Consistly is a habit tracking application that allows users to create, track, and visualize their daily habits using heatmap-style visualizations. We offer both free and premium subscription plans.
3. User Accounts
To use Consistly, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized use
4. Subscription and Billing
Free Plan
The free plan allows you to track up to 4 habits at no cost.
Premium Plan
The Premium plan costs $3 per month and provides unlimited habit tracking. Subscriptions are billed monthly and will automatically renew unless cancelled.
Cancellation
You may cancel your Premium subscription at any time. Upon cancellation, you will retain access to Premium features until the end of your current billing period.
Refunds
We offer refunds within 7 days of your initial Premium subscription purchase. After this period, no refunds will be provided for cancellations.
5. Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Upload malicious code or content
- Impersonate any person or entity
- Use automated systems to access the service without permission
6. Intellectual Property
The Consistly service, including its design, features, and content, is owned by us and protected by intellectual property laws. You retain ownership of your habit data.
7. Data and Privacy
Your use of Consistly is also governed by our Privacy Policy. You grant us a limited license to store and process your habit data solely to provide our service.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time.
9. Limitation of Liability
To the maximum extent permitted by law, Consistly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
10. Disclaimer of Warranties
The service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use after changes constitutes acceptance.
12. Termination
We may terminate or suspend your account at any time for violation of these terms. You may also delete your account at any time through your account settings.
13. Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
